Limitation of Liability

IN ALL CIRCUMSTANCES BEAUTIMAS’ MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. BEAUTIMAS SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. BEAUTIMAS SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT BEAUTIMAS HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES. 

Some U.S. states and foreign countries provide rights in addition to those above or do not allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages. Therefore, the above limitations may not apply to you, or there may be state provisions that supersede the above. Any clause of this disclaimer declared invalid by the appropriate authority shall be deemed severable and shall not affect the validity or enforceability of the remainder of this disclaimer.

Recordings

Beautimas does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. Customer agrees not to record any call with Beautimas unless Customer has provided clear and conspicuous notice to Beautimas and has received prior written consent from Beautimas. 

Governing Law and Jurisdiction

Any dispute arising out of or related to these Terms and Conditions or any sales transactions between Beautimas and Customer shall be governed by the laws of the State of Washington, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Beautimas and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Washington, Gray’s Harbor County, to resolve any dispute between them related hereto, and the parties waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity, or otherwise, against Beautimas that is more than one year after the date of the applicable invoice. 

Severability

If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Washington State law. 

Waiver

The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing. 

Users of this Site (sometimes "you") shall not access or use this Site from territories where its contents or use are illegal, restricted or prohibited by law. Beautimas is not responsible for your access or use from such a territory. By accessing this Site, you not only agree to be bound by these Terms of Use, you also agree to be bound by all applicable laws and regulations (including export and re-export control laws), and you agree that you and you alone are responsible for compliance with any applicable local laws.

Disputes

Any dispute or claim arising  out of use of the Beautimas website will be resolved by binding arbitration,  rather than in court, except that you may assert claims in small claims court  if your claims qualify. The Federal Arbitration Act and federal arbitration law  apply to this agreement.  There is no  judge or jury in arbitration, and court review of an arbitration award is  limited. However, an arbitrator can award on an individual basis the same  damages and relief as a court (including injunctive and declaratory relief or  statutory damages), and must follow the terms of these Terms & Conditions  as a court would.

The arbitration will be  conducted by the American Arbitration Association ("AAA") under its  rules, including the AAA's Supplementary Procedures for Consumer-Related  Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879.  Payment of all filing, administration and arbitrator fees will be governed by  the AAA's rules.

We and you agree that  any dispute resolution proceedings will be conducted only on an individual  basis and not in a class, consolidated or representative action. If for any  reason a claim proceeds in court rather than in arbitration we each waive any  right to a jury trial. We and you also agree that you or we may bring suit in  court to enjoin infringement or other misuse of these Terms & Conditions.

Entire Agreement

These terms and conditions, together with Beautimas' invoice regarding the products ordered by Customer, are the complete and exclusive agreement between Beautimas and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Beautimas and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage. 

Beautimas reserves the right to seek all remedies available at law and in equity for violations of these Terms of Use, including but not limited to the right to block access from a particular Internet address to this Site and its features. Beautimas reserves the right to investigate complaints or reported violations of our Terms of Use and to take any action Beautimas deems appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties, and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.

Beautimas will determine your compliance with these Terms of Use in its sole discretion. Any violation of these Terms of Use may result in restrictions on your access to all or part of this Site and may be referred to appropriate enforcement authorities.

You are hereby advised that Beautimas will aggressively enforce its rights to the fullest extent of the law, including, without limitation, the seeking of criminal prosecution.

We reserve the right to  modify these Terms and Conditions at any time, so please review it frequently.  If we make material changes to this policy, it will be posted on our website.
